1. Overview#

Third Eye Cyborg, LLC responds to government and law-enforcement requests in accordance with applicable law. We require valid legal process for the disclosure of user content and most non-public account information, and we narrow the scope of disclosures to what is legally compelled.

2. Required legal process#

  • Subpoena — basic subscriber information (account email, registration metadata).
  • Court order under 18 U.S.C. § 2703(d) or equivalent — non-content records (logs, IP history, metadata).
  • Search warrant — content of communications, post bodies, private media, and similar non-public content.
  • MLAT or letter rogatory — for most non-US government requests, unless an emergency.

3. Emergency disclosure requests#

We disclose information without legal process only where we have a good-faith belief that an emergency involving danger of death or serious bodily harm to any person requires it (per 18 U.S.C. § 2702(b)(8) and equivalent provisions). Emergency requests must be sent from an official government email and include the nature of the emergency and the specific accounts involved.

4. Preservation requests#

We assess preservation requests under applicable law. This page does not represent that a child-safety evidence-preservation process is currently operational; the responsible operator must document and confirm that process before it is stated as an active capability. Preservation, when operationally confirmed and legally required, does not constitute disclosure; legal process is still required to receive preserved data.

5. User notice#

Our policy is to notify affected users of legal process for their account before disclosure unless we are legally prohibited from doing so (e.g., a sealed order or non-disclosure provision) or we have a good-faith belief that notice would create a risk of serious harm or enable destruction of evidence.

6. Cost reimbursement#

We may seek reimbursement for costs incurred in responding to legal process where authorised by law.

7. How to send requests#

Submit legal process to [email protected]. Service by email is acceptable; service by mail is acceptable but may delay response. We do not accept service of legal process through social media or in-app messages.

8. Transparency report#

See our Transparency Report for aggregate counts of government and copyright requests we have received and how we have responded.
