1. Overview#

Third Eye Cyborg, LLC ("we", "us") respects the intellectual-property rights of others and expects users of Ascended Social to do the same. This page describes how copyright owners can submit takedown notices, how users whose content has been removed can submit counter-notices, and the policy we apply to repeat infringers.

You can upload your own sigil image if you own it or have the right to use it. Uploaded sigils are held for review before anyone else can see them. In Human Community mode, a person reviews them and they're never sent to AI providers. In AI-assisted mode, they're checked by the same automated image tools we use for post images (OpenAI's moderation API and Cloudflare) before review. Copyright complaints about uploaded sigils use our DMCA Policy and in-app copyright reporting.

2. Designated Agent#

Notices of claimed copyright infringement should be sent to our designated agent:

DMCA Agent — Third Eye Cyborg, LLC
Email: [email protected]
Mailing address available on request.

3. Submitting a Takedown Notice#

To be effective under 17 U.S.C. § 512(c)(3), a notification must include:

  • A physical or electronic signature of the rights holder or an authorised agent.
  • Identification of the copyrighted work claimed to be infringed.
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (URL or in-app permalink).
  • Your name, address, telephone number, and email address.
  • A statement that you have a good-faith belief that use of the material is not authorised by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the rights holder or authorised to act on the rights holder's behalf.

Knowingly making false claims of infringement may result in liability under 17 U.S.C. § 512(f).

4. Counter-Notice#

If your content was removed and you believe the removal was a mistake or misidentification, you may submit a counter-notice to the same address that includes:

  • Your physical or electronic signature.
  • Identification of the material that has been removed and the location at which it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the United States, any judicial district in which we may be found) and that you will accept service of process from the original complainant.

Where applicable we will forward valid counter-notices to the original complainant and may restore the removed material in 10–14 business days unless we receive notice of a court action.

For platform moderation restrictions related to copyright actions, users may also file an in-product appeal (when available) or email [email protected]. Appeals are limited to three attempts per enforcement target and may be auto-denied when the review SLA expires without a decision.

5. Repeat-Infringer Policy#

We maintain a documented repeat-infringer policy. Users who are the subject of multiple substantiated copyright complaints will receive escalating responses up to and including permanent termination of their account, removal from creator-monetisation features, and forfeiture of pending payouts.

6. In-Product Reporting#

The fastest way to flag copyright issues from inside the product is via the in-app copyright report flow. Reports submitted that way are surfaced to the same moderation team that processes formal DMCA notices.
